Odisha seeks ESMA enforcement amid power supply employees’ protest

Bhubaneswar: The Odisha Energy Department has sought strict enforcement of the Essential Services Maintenance Act (ESMA) against employees of power utilities amid an ongoing strike and protests that could disrupt electricity supply across the state.

In a letter dated October 12, 2026, Additional Chief Secretary of the Energy Department, Vishal Kumar Dev, urged the Director General and Inspector General of Police to direct the concerned police authorities to ensure strict enforcement of ESMA against power utility employees in the event of any violation.

The letter refers to an ongoing demonstration and strike by members of the Nikhila Odisha Bidyut Mazdoor Mahasangha (NOBMM), affiliated with BMS Odisha, under the leadership of its general secretary, Satyabrata Parida. The agitation has been continuing within the jurisdiction of TP Central Odisha Distribution Limited (TPCODL) since October 1.

According to the Energy Department, despite efforts by TPCODL management to resolve the dispute through dialogue and mutual understanding, the protesters may continue their agitation, including mass demonstrations and a complete stoppage of work.

The department has warned that the continuation of the strike could disrupt electricity supply, cause hardship to the general public and affect essential service establishments. It also expressed concern that the agitation could lead to law-and-order problems.

TPCODL is responsible for electricity distribution across nine districts of Odisha. The department said a prolonged work stoppage could seriously affect the uninterrupted supply of electricity to consumers.

The letter states that ESMA was imposed on power utilities, including GRIDCO, OPTCL, OHPC, OPGC and the distribution companies, through a Home Department order dated May 21, 2026. The order was issued for six months to prevent strikes and maintain industrial peace.

According to the letter, the ESMA order remains in force until November 20, 2026. The Energy Department has argued that the ongoing strike warrants immediate intervention to safeguard the uninterrupted provision of electricity, given the essential nature of the service.

The Additional Chief Secretary has requested the police leadership to impress upon the concerned local police authorities the need for stringent enforcement of ESMA. The letter also calls for strict action, as permissible under the law, against any association or official found violating the provisions.
